Arbitration at
first stage: The parties (claimant and defendant) appoint one
arbitrator each who jointly appoint an umpire. If the two arbitrators cannot
agree on an award the umpire will decide the outcome instead.
Appeals and
hearings before a board of arbitration: In both these cases the BCA appoints the arbitrators: three for quality disputes, and five for all other
(i.e. technical) disputes.
The parties to the dispute may object, in writing,
to the appointment of any arbitrator or arbitration board member. No arbitrator
or arbitration board member may be, or become, directly or indirectly involved
in a case they are officiating in.
